Krogerus advised Pohjolan Matka before the Supreme Administrative Court

Krogerus advised the Pohjolan Matka group of companies before the Supreme Administrative Court following a proposal by the Finnish Competition and Consumer Authority ("FCCA") to impose a fine for prohibited cooperation in the bus transport market.

The fine proposed by the FCCA to Pohjolan Matka amounted to EUR 2.1 million. In its yearbook decision (KHO:2019:98), the Court imposed a remarkably lower fine to Pohjolan Matka, amounting to EUR 300 000. Compared to the FCCA's proposal in 2016, the scope and duration of the alleged infringement were considerably narrower.

The proposed fines by the FCCA in total amounted to EUR 38 million for all the parties concerned. In its December 2017 ruling, the Market Court rejected a substantial part of the FCCA's original proposal, leading to notably lower fines than proposed, totalling EUR 1.1 million for all parties. The ruling was appealed to the Supreme Administrative Court both by the FCCA and the parties concerned.
