The Supreme Administrative Court dismisses the Finnish Competition and Consumer Authority's appeal
The Finnish Supreme Administrative Court has dismissed the Finnish Competition and Consumer Authority's ("FCCA") appeal regarding legal costs in a competition law case concerning alleged prohibited cooperation between companies in the market for plastic infrastructure pipe products in Finland.
The judgment brings to an end competition proceedings which lasted over 10 years.
In August 2024, the Market Court rejected the FCCA's penalty payment proposal. The Market Court did not consider the evidence submitted by the FCCA in this case to be sufficient and ordered the FCCA to reimburse part of the companies' legal costs. The FCCA appealed only in relation to legal costs, but the Supreme Administrative Court upheld the Market Court's decision. In addition, the Supreme Administrative Court ordered the FCCA to reimburse part of the companies' litigation costs incurred during the Supreme Administrative Court proceedings.
