In recent years, legal issues concerning state aid in company reorganisations have attracted much attention. One controversy that has arisen is the circumstances under which a write-off of state claims in a creditor arrangement within the framework of a company restructuring constitutes a form of state aid forbidden under EU law.

The European Commission has addressed this issue in a case concerning Slovakia, and the consequences of the Commission’s conclusions may affect restructuring processes in Finland as well.
